Sexual Harassment
Massachusetts law forbids sexual harassment discrimination in the workplace. There are 2 types of sexual harassment: "Hostile Work Environment" harassment and "Quid Pro Quo" Harassment" - which may occur separately or together.
Like many of the clients that we have successfully helped to secure relief and financial compensation, you may be a victim of an unlawful Sexually Hostile Work Environment if you have been subjected to:
- unwelcome sexual advances or requests for sexual favors, or
- other offensive verbal OR physical sexual conduct
- which unreasonably interferes with your work performance
- and creates an intimidating, hostile, humiliating or sexually offensive work environment for you.
Examples:
- sexual language "jokes" or gossip
- sexual comments; requests for sex;
- displaying sexually suggestive pictures and objects
- comments about sex lives
- staring/leering at your body in a sexually intimidating manner;
- whistling, or sexual gestures;
- inappropriate touching;
- inappropriate comments about your body, appearance, or clothing, etc.
Like many of the clients that we have successfully helped to secure relief and financial compensation, you may be a victim of unlawful Quid Pro Quo Sexual Harassment, if you have been subjected to:
- unwelcome sexual advances or
- requests for sexual favors or
- other verbal or physical conduct of a sexual nature
- to which you have submitted in fear that you must do so or else you will suffer some adverse action by your employer, such as firing, discipline, denial of promotion, raises; giving you bad evaluations or work assignments, etc. OR
- you have refused to submit and your employer has held it against you by taking adverse action such as firing, discipline, denial of promotion, raises, work assignments, evaluations, etc.
Examples:
- an employee with authority or control over your work offers you a work benefit or advantage in exchange for your granting sexual favors, OR
- you are denied a work benefit or advantage due to your rejection of requests for sexual favors.
